Terms of Service

Welcome to EstateMage. These Terms of Service (the Terms) govern your access to and use of EstateMage, the website at estatemage.com, and the related software and services (together, the Service). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What EstateMage Does
EstateMage is software for estate-sale organizers. It lets you create estate-sale listings, publish them, and embed them on your own website as well as on the EstateMage public directory at estatemage.com. Each listing can include sale details, individual item descriptions, and photos. Shoppers can browse published sales and follow an organizer to receive email updates about future sales.
2. Eligibility and Your Account
You must be at least 18 years old and able to enter into a binding agreement to use the Service. You create an account using email and password or by signing in with Google, handled through our authentication provider. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Please let us know promptly at support@estatemage.com if you believe your account has been used without your permission.
3. Plans, Billing, Refunds, and Cancellations
Payments are processed by Stripe. When you sign up, your first listing is free: we grant a complimentary listing credit to your account. This complimentary credit has no cash value and is not refundable or transferable. Beyond that, you can pay as you go with a one-time Single Sale listing credit for $19.99, or subscribe to Monthly Unlimited for $29.99 per month, which lets you publish unlimited listings while the subscription is active. Prices are shown in U.S. dollars and do not include any taxes that may apply.
- Unused Single Sale credits. If you purchase a credit and have not yet used it, you can request a full refund within 14 days of purchase by emailing support@estatemage.com with the email address on your account. Approved refunds are returned to your original payment method through Stripe. Unused credits do not expire.
- Used credits. Once a credit is applied to a listing and that listing goes live, the credit has been used and is non-refundable, because the service it pays for has been delivered.
- Subscription cancellation. The Monthly Unlimited subscription renews automatically each billing period until you cancel it, which you can do at any time through the Stripe billing portal reached from your dashboard. Your subscription stays active through the end of the period you have paid for; we do not provide partial or prorated refunds for the unused portion of a billing period.
- Listings after cancellation. When your subscription ends, listings you published while subscribed may be unpublished from the public directory unless they are covered by an available Single Sale credit.
If a payment fails, we may pause access to paid features until the balance is resolved. If you think you were charged in error or notice a billing issue, contact us at support@estatemage.com and we will look into it promptly.
4. Your Content
You keep ownership of the content you add to the Service, including your company profile, sale and item descriptions, and photos (your Content). By adding Content, you grant EstateMage a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it for the purpose of operating and providing the Service, including showing your listings in the public directory and rendering the embeds you place on your own website.
You are responsible for your Content and you represent that you have the rights needed to post it, that it is accurate, and that it does not infringe anyone else's rights or break any law. You are responsible for the accuracy of sale dates, locations, pricing, and item descriptions.
5. Acceptable Use
You agree not to use the Service to:
- list items you do not have the legal right to sell, or items that are illegal to sell;
- post content that is false, misleading, infringing, defamatory, or otherwise unlawful;
- impersonate another person or business, or misrepresent your affiliation;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems; or
- scrape, harvest, or collect data from the Service except through features we provide for that purpose.
We may remove Content or suspend accounts that we reasonably believe violate these Terms or put other users, shoppers, or the Service at risk.
6. Public Listings and Embeds
When you publish a listing, it becomes publicly visible in the EstateMage directory and through any embed you add to your own website. Anything you include in a published listing may be seen and shared by the public. Please do not include information in a listing that you would not want to be public.
7. Shopper Follows and Email
Shoppers can follow an organizer by providing their email address, and we send email on your behalf through our email provider so followers can learn about your upcoming sales. Every email includes a way to unsubscribe, and shoppers can opt out at any time. You agree to use follow-based email only for legitimate updates about your sales and not for unrelated or unsolicited messaging.
8. Third-Party Services
The Service relies on trusted third parties to function, including Stripe for payments, Supabase for authentication, Convex for data storage, Resend for email, and Google for optional sign-in. Your use of those features is also subject to those providers' own terms. We are not responsible for the acts or omissions of third-party providers.
9. Intellectual Property
EstateMage, including its software, design, logos, and content we create, is owned by EstateMage and protected by intellectual property laws. These Terms do not give you any right to use our name, branding, or software except as needed to use the Service as intended.
10. Disclaimers
The Service is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your specific requirements. EstateMage is a listing and publishing tool; we are not a party to any transaction between organizers and shoppers, and we are not responsible for the outcome of any estate sale.
11. Limitation of Liability
To the fullest extent permitted by law, EstateMage will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold EstateMage harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your Content, your use of the Service, or your violation of these Terms.
13. Termination
You can stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we need to for legal or security reasons. If your account is terminated, published listings may be removed from the public directory. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limitations of liability) will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws applicable in the jurisdiction in which EstateMage operates, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Service will be resolved in the courts of that jurisdiction.
